Introduction

Aventit AG operates in various countries. In this Privacy Policy (the "Privacy Policy"), "Aventit AG", "we" and "us" means the company that provides the AV.Park service and related services, including subscriptions and pay-per-use services (the "Services").
In this Privacy Policy, we explain the categories of personal data Aventit collects, why Aventit collects that data, and what Aventit uses that personal data for in connection with the services, AV.Park's mobile device app (the "App"), or AV.Park's website (the "Website"). This will enable you to exercise your privacy rights.
Aventit processes personal data in accordance with applicable data protection laws. Aventit is the controller of the processing of personal data described in this Privacy Policy.
Personal data is any information relating to an identified or identifiable natural person.
Aventit provides the Services both to private customers (B2C) and to business customers whose employees use the Services (B2B). This Privacy Policy applies to both types of customers.

Personal data sources

Your personal data

The personal data that may be processed is primarily data that you yourself provide directly or indirectly to AV.Park. AV.Park collects your personal data, for example, when you:

• open an account at AV.Park
• Use the services, the app and the website; and
• when you contact Aventit

Personal data collected by information service providers

Where appropriate, we collect personal data from information service providers to match our customer data with public registers to ensure that we have up-to-date and accurate information, such as the correct vehicle license plate number and vehicle model.

Provision of the services

AV.Park processes your personal data to provide the Services.

• Name
  Is required to be able to identify you uniquely. It will be given to the parking lot operator where you make a booking.
  Mandatory for payments by credit card or other payment methods.
• Email
  Used for login purposes and to contact you.
• Phone number
  Used exclusively for communication purposes or to help link parking space discount offers.
  
• Full address
  Mandatory for payments by credit card or other payment methods.
  
• License plate, UHF tags, vehicle QR codes
  Required for unique vehicle identification together with the vehicle type during a parking procedure.
  
• Parking data (arrival and departure times, zone)
  Used for parking time and cost calculation.
  
• Location data via GPS
  The location data is only used when the app is in the foreground. The received location data is not stored, but is used exclusively to identify the parking zone and thus for the convenience of the user.
  
• Payment details
  The payment details such as card number are stored exclusively with the payment provider. The AV.Park services never store all the infor-mation required for a payment, but always possess only parts or proxies for a means of payment. The security of the payment means data is therefore guaranteed.
  
• Booking and park history
  This data is stored for twelve (12) months and then deleted.
  

Promotional messages and offers

AV.Park processes your personal data within the framework of communication with you concerning the services and for the purpose of submitting offers regarding AV.Park's services and products.

Conducting surveys

Aventit reserves the right to use your personal data for conducting surveys on the AV.Park services, for example, in the form of a request for feedback and ratings via the App, by SMS or by email. Please note that you should not share any personal data when entering your feedback in the free text field. If this is unavoidable, please only provide personal data that is necessary for the feedback you wish to provide.

Processing of inquiries and customer service matters

Aventit processes personal data to handle your requests through various channels, for example when you contact our customer service.

Fulfillment of legal obligations

Aventit processes personal data in order to comply with legal obligations to which Aventit is subject, such as accounting obligations.

Assertion and exercise of and defense against legal claim(s)

Aventit processes personal data for the purpose of asserting and exercising or defending against legal claim(s), for example in connection with an out-of-court dispute or legal proceedings.

Maintenance, protection and development of the services

Aventit processes personal data for the purposes of maintaining, protecting and developing the services, the app and the website, for example, to document, develop, test and improve our services.

Safety

Aventit takes the security of your personal data very seriously. Aventit implements appropriate technical and organizational measures to protect your personal information from unauthorized access, alteration or destruction. Access to information is limited in various ways (for example, through user permissions and passwords that are queried and assigned only to employees who need access to such information to perform their job duties). Other security measures include encryption, firewalls, and physical limits and restrictions on building access and file access.
The data is hosted by a reputable Swiss provider and is secured from outside access with reasonable technical effort.
All communication between the services is encrypted. The encryptions are implemented using the latest standards.

Recipients of personal data

Aventit shares collected personal data with the following recipients for the purposes set forth below. The recipient is the controller for its own processing of the personal data we share with it, unless otherwise specified below.

Parking lot operator

We share data with parking operators to provide the services and to enable the parking operators to control and verify parking operations on their premises. When you park in a parking zone, your car license plate number or the unique identification number of the RFID card, QR code or UHF tag is shared with us and the parking operator so that the parking process can start or end at AV.Park.

Creditor and payment service provider

If payments are made by means of payment, e.g. credit card, Twint or Paypal (list not exhaustive), the personal data required by law will be shared with payment service providers.

Other recipients

In addition to the recipients listed above, Aventit may share your personal information with the following recipients when necessary:

1. Authorities
   We share your personal data with public authorities to comply with legal obligati-ons, to assert, exercise or defend legal claims, or to cooperate with public authori-ties.
   
2. Courts, external consultants and counterparties
   In the event of disputes, we may transfer data to other parties for the assertion, exercise or defense of legal claims.
   
3. Law enforcement authorities, e.g. the police
   We may share personal information with law enforcement authorities, such as the police, if we are required to do so by law or to contribute to an ongoing criminal investigation or to assert, exercise or defend legal claims.
   
4. Potential buyers and sellers and their respective external consultants
   Where appropriate, we share information with potential buyers and sellers should we transfer all or part of our business or if a merger occurs.

AV.Park uses cookies to optimize the services, to perform statistical evaluations and for analyses. A cookie is a text file that is stored on your computer, for example, so that your computer can be identified. Cookies help Aventit to customize or optimize the website based on, for example, your user requests as a user of AV.Park's services and website.

Right to information

You have the right to obtain confirmation from us as to whether we are processing personal data relating to you and to request a copy of the personal data we process about you. You can access some of your data stored by us by logging into your personal account in the app or on the website.

Right to rectification

If your personal data processed by AV.Park is inaccurate or incomplete, you have the right to ask Aventit to correct the personal data. You can correct some personal data yourself by logging into your personal account in the App or on the Website.

Right to deletion

Under certain circumstances, you have the right to have your personal data deleted if, for example, you have objected to the processing and there are no overriding legitimate reasons for AV.Park to continue processing the data. This does not apply if, for example, we are required by law to store the data.

Revocation of consent

If the processing is based on your consent, you have the right to withdraw your consent at any time. To do so, please contact our customer service using the contact details provided at the end of this privacy policy. Please note that the revocation of consent does not affect the lawfulness of the processing that took place prior to the revocation.

Changes to the privacy policy at AV.Park

Aventit may change the Privacy Policy from time to time. In case of changes to AV.Park's Privacy Policy that result in a change in the way Aventit processes your personal data, for example, the collection of additional personal data for the stated purposes or the processing of data for new purposes, Aventit will inform you of such changes, for example, via the Website, the App, by SMS or by email. Aventit recommends that you regularly review the Privacy Policy to see how AV.Park processes your personal data.
